HIPAA and data security. mConsent operates as a Business Associate under the Health Insurance Portability and Accountability Act (HIPAA) and executes a Business Associate Agreement (BAA) with each customer prior to handling protected health information. Each covered entity remains solely responsible for its own HIPAA compliance obligations, including workforce training, access controls, and breach notification. Nothing on this page constitutes legal or compliance advice.
TCPA and SMS messaging. mConsent’s SMS features are designed to support TCPA compliance workflows including patient opt-in consent collection. Your practice is solely responsible for obtaining and maintaining lawful prior express written consent from patients before sending text messages, and for complying with all applicable federal and state telecommunications laws. Consult legal counsel before deploying SMS communications.
